Warranty & Limitation of Liability:
We adhere to the policies of each original
manufacturer that we represent (their individual policies are
available). Their warranty will supersede this one when in conflict.
In most cases our products are warranted for a period of one year from
the date of shipment to be free from defects in material and workmanship
under correct use, normal operating conditions, and proper application.
Our burlap products will degrade over time since they are made of a
natural fiber. We make every attempt to maintain a new inventory
of burlap (90 days) and will not accept retuns older than 60 days in in
us-used condition. Normal obligation under the warranty shall be limited to the repair of
exchange at our and / or the manufacturers option. FOB the manufacturer
or our place of business if the product or part proves to be defective
as provided herein. We reserve the right to inspect the product at the
Buyer's location or require it to be returned freight prepaid to our
specified location for inspection. The warranty does not extend to
goods damaged, or subject to accident, abuse or misuse after shipment
from the original manufacturer, nor to goods altered or repaired by
anyone other than a authorized representative.
The buyer or user shall not alter, modify, or use a
product for anything other than its intended function. We or the
manufacturers we represent shall not in any way be responsible for the
consequences of any such alteration, modification or misuse.
We make not express warranties other than those
which are specifically described herein and by our manufacturers.
This warranty is expressly in lieu of all other
warranties, express or implied. There are no implied warranties or
merchantability or fitness for a particular purpose. This warranty
states our and our manufacturers entire and exclusive liability, and
buyers exclusive remedy for any claim for damages in connection with the
sale or furnishings of our products, their design, suitability for use,
installation or operation or for any claimed defects therein. We or our
manufacturers will in no event be liable for incidental of consequential
damages whatsoever, not for any sum in excess of the price for the goods
for which liability is claimed.
Returns:
We and our manufacturers ship only first-quality
merchandise after thorough inspection in strict compliance with customer
orders. Returned items must have a written statement describing the
reason for return. All returns must have prior written factory approval
and a Return Aurthorization Number. Returns made otherwise may not be
accepted at the receiving point and may result in customer liability for
carrier storage charges and damages. Authorized returned merchandise
will be subject to a 25% restocking charge (based on list price) plus
applicable freight charges. The buyers return authorization will
contain instructions regarding disposition and shipping address to be
used for the returned merchandise.
Payment Terms:
Terms are net 20 days with approved credit.
MasterCard, Visa, Wire Transfers are accepted or payments thru PayPal.
Quoted freight rates or delivered prices are for the continental United
States only.
Shipments will be invoiced at prices in effect on
the date of invoice, and any unpaid balance shall be subject to a late
charge of 1.5 percent per month thereafter. Minimum order policy is
normally $75.00, replacement parts $30.00. Some product lines will be
different.
Freight:
Shipments are made FOB origin unless otherwise
quoted. merchandise is shipped either FOB origin Freight collect, FOB
origin freight prepaid and added to the customer invoice.
Freight Claims:
It is the receiving party's responsibility to make
the proper notations on freight bills at the time of receipt of a "short
shipments" or damaged merchandise. It is also the receiving party's
responsibility to initiate all claims with the delivering carriers, and
follow up on such claims until a satisfactory settlement is made with
the said carrier.
We or our suppliers are not responsible for short
shipments due to loss by the carrier and / or damage in transit. |
